According to the lawsuit obtained by People magazine, Tempo Music Investments alleges there are striking similarities between Mars’ song and the hit “Flowers.”

“It is undeniable based on the combination and number of similarities between the two recordings that ‘Flowers’ would not exist without ‘When I Was Your Man.'” The document continues to state that the song, “duplicates numerous melodic, harmonic, and lyrical elements” of Mars’ track.” The lawsuit further highlights the similarities between the two songs, claiming that “the opening vocal line from the chorus of Flowers begins and ends on the same chords as the opening vocal line in the verse of ‘When I Was Your Man.'”

However, this isn’t the first time the two songs have been compared for their similarities. Last year, Billboard published an article clarifying that Cyrus did not owe the “Die With a Smile” artist credit for the song. “Not only are there no direct samples or obvious interpolations between ‘Flowers’ and Your Man,’ there are no major sonic overlaps either — no obvious shared melodies or rhythms, no major similarities in production textures.” Billboard went on to state that the only real connection between the two songs is that they share similar themes.

Tempo Music Investments have requested that the singer stop performing “Flowers” for the alleged “exploitation.” The lawsuit concludes these claims, stating, “Tempo Music Investments wants Cyrus, 31, and the defendants listed in the suit to stop reproducing, distributing or publicly performing ‘Flowers.'”

Neither artist has yet to comment on the lawsuit. You can stream “Flowers” here and “When I Was Your Man,” here.
